Failed marriage not end of life, look ahead, Supreme Court tells young couple


If a marriage has failed, it is not the end of life for the man and woman and the couple has to look ahead, the Supreme Court remarked while dissolving the marriage of a couple. A bench led by Justice Abhay Oka court dissolved the marriage, which took place in May 2020, and terminated all 17 proceedings filed by the couple against each other and advised them to move on.

“The parties are young. They must look ahead towards their future. If the marriage has failed, that is not the end of life for both.They must look ahead and start a new life,” the court remarked.

The couple is requested to now live peacefully and proceed further in life, the court added.

The court described it as one of those unfortunate cases where, within a year of marriage, the wife was compelled to leave her matrimonial home, alleging continuous harassment by her husband and in-laws.

The court advised the lawyers representing both parties that contesting these litigations would be futile, as they could drag on for years.

Subsequently, the lawyers requested the court to exercise its jurisdiction under Article 142 of the Constitution of India to dissolve the marriage.

The woman has been living at her parents’ home since shortly after their 2020 marriage, as the relationship soured.
